These Terms and Conditions govern purchases made on binya.co. By placing an order you confirm that you have read and accepted them. Please read them before you buy.

Who we are

The seller is Vanesa Delgado Fernández, trading as BINYA, with tax ID 28843516K and registered at Sevilla, Spain. You can contact us at hola@binya.co. More information about us is in our Legal Notice.

Who can buy

You must be at least 18 years old to place an order. We sell to the countries and regions that are available at checkout.

Products

We do our best to show our clothing and accessories as they are, but colours may vary slightly depending on your screen. Our Size Guide will help you choose your size. All products are subject to availability. If an item you ordered is no longer available, we will let you know as soon as possible and refund anything you have paid.

Prices and payment

All prices are shown in euros and include VAT, unless stated otherwise. Shipping costs and any applicable taxes or duties are shown at checkout before you confirm your order. Payment is made at checkout with the payment methods available there. We do not see or store your card details, which are processed securely by our payment providers. We may change our prices at any time, but the price you see when you place your order is the one you will pay.

How to place an order

To buy, add the products to your cart and follow the steps at checkout. You will be able to check and correct your order before paying. Once your order is placed, you will receive a confirmation email. The sales contract is formed when we confirm your order. We may cancel an order for justified reasons, such as an error in the price or a payment problem, and in that case we will refund you in full.

Shipping

Delivery times, costs and destinations are explained on our Shipping page. Delivery times are an estimate and we are not responsible for delays caused by the courier or by circumstances outside our control. Please check your parcel when you receive it and tell us as soon as possible if it arrives damaged.

Right of withdrawal and returns

If you are a consumer, you have the right to withdraw from your purchase within 14 days of receiving your order, without having to give a reason. To do it, tell us clearly by email at hola@binya.co within that period. The conditions to return the items, who pays for the return shipping and how we refund you are explained on our Returns page. We will refund you within 14 days of receiving your decision, using the same payment method you used to buy, and we may wait until we have received the items back.

Items must be returned unused and in their original condition. For hygiene reasons, you cannot return swimwear or underwear once the protective hygiene seal or label has been removed. Personalised or made-to-order items are also excluded from the right of withdrawal.

All our products have the legal guarantee of 3 years from delivery established by Spanish consumer law. If you receive an item that does not conform to what you ordered or has a defect, contact us at hola@binya.co with your order number and photos, and we will repair it, replace it or refund you as the law provides.

Intellectual property

All the images, texts, designs and the BINYA brand are our property and are protected, as explained in our Legal Notice.

Personal data

We use your data to manage your order, as explained in our Privacy Policy.

Complaints and disputes

If you are not happy with something, write to us first at hola@binya.co and we will do our best to solve it. We also have complaint forms available to consumers. If you are in the European Union, you can use the online dispute resolution platform of the European Commission at https://ec.europa.eu/consumers/odr.

Applicable law

These Terms are governed by Spanish law. For any dispute, the courts of Sevilla will be competent, unless the law gives consumers the right to go to the courts of their place of residence.

Changes to these terms

We may update these Terms from time to time. The version in force when you place your order is the one that applies to it.
