At BINYA we take your privacy seriously. This policy explains what personal data we collect when you visit binya.co, shop our clothing and accessories or get in touch, why we use it and what rights you have. It complies with the EU General Data Protection Regulation (GDPR) and the Spanish Organic Law 3/2018 on Data Protection (LOPDGDD).

Who is responsible for your data

The data controller is Vanesa Delgado Fernández, trading as BINYA, with tax ID [NIF] and registered address at [full address], Sevilla, Spain. You can contact us at hola@binya.co.

What data we collect and why

We collect your name, email, phone number, shipping and billing address and order details when you place an order or create an account. We use them to process and deliver your purchase, manage returns and issue invoices. The legal basis is the performance of the purchase contract and our legal tax and accounting obligations.

If you write to us, we use your name, email and message to reply. If you subscribe to our newsletter, we use your email to send you news about collections and offers. In this case the legal basis is your consent, and you can withdraw it at any time using the unsubscribe link in each email or by writing to us.

Payment details are handled directly by our payment providers. BINYA never sees or stores your card number. We do not make automated decisions about you.

How long we keep your data

We keep order and invoice data for the period required by Spanish tax and commercial law, which is generally six years. Account data is kept until you ask us to delete it. Newsletter data is kept until you unsubscribe. Messages are kept for as long as needed to answer you. After these periods, your data is deleted or blocked.

Who we share it with

We do not sell or rent your data. We only share it with the providers we need to run the shop: our e-commerce platform and hosting, payment processors, couriers who deliver your order, our email service and our accountant. They only process data on our behalf and under a data processing agreement. We may also share data with public authorities when the law requires it.

Some of these providers may store data outside the European Economic Area. In that case, transfers are protected by an adequacy decision of the European Commission or by Standard Contractual Clauses.

Your rights

You have the right to access, rectify, erase, object to, restrict and port your data, and to withdraw your consent at any time. To exercise them, send an email to hola@binya.co indicating which right you want to exercise. We will reply within one month. We may ask you to confirm your identity if we have reasonable doubts. If you think we have not handled your data properly, you can file a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es.

Security and cookies

We apply technical and organisational measures to protect your data, and our website uses an encrypted HTTPS connection. This website uses cookies, which you can read about in our Cookie Policy.

Changes to this policy

We may update this policy when the law or our services change. The current version is always published on this page.
